China: Communist Party calls for crackdown on ‘enemy forces’ after unprecedented protests


China’s top security agency today called for “suppression” of “enemy forces” and more freedoms in China’s major cities after protests over health restrictions.

The ruling Communist Party’s Political and Judiciary Commission, which oversees law enforcement in the country, said it was “necessary to suppress the infiltration and sabotage activities of enemy forces under the law,” according to the minutes of the meeting released by the Chinese Xinhua News Agency.

Of crucial importance in the text is the “strict legal suppression of criminal acts that aim to overthrow the social order, but also the consistent protection of social stability”.

China’s zero-case-of-Covid policy, in place for nearly three years, has been the target of protests in several cities this weekend, the largest protest movement since the pro-democracy protests that were violently repressed in 1989.

This protest comes against a background of deep frustrations with the political system.

However, a large police force stationed in the country’s major cities appears to have beaten back the protesters today, according to AFP reporters in Beijing and Shanghai.

Unprecedented protests continue in China

A wave of anger has erupted in China in recent days following the authorities’ strict “zero-Covid” measures and strict censorship. Unprecedented protests have erupted in many Chinese cities against strict measures and testing for COVID-19, but also for curfews. Citizens are also expressing their anger at the Communist Party’s strict censorship and even stricter influence in all walks of life.

Slogans chanted by the protesters include “No Covid test, we’re hungry!”, “Xi Jinping, resign!”, “No to lockdowns, we want freedom” and anti-Chinese Communist Party slogans.

The wave of protests in China has roiled the markets, with stocks and the price of oil falling. The reason for the outbreak of the protests was the death of 10 people after a fire in a residential building in the city of Ürümqi in the Xinjiang region. The victims were reportedly unable to escape due to the building being locked down. It is also reported that firefighters were unable to approach the blaze as fire engines were blocked from checkpoints as part of the pandemic measures.

Some demonstrations broke up peacefully, others led to clashes with Chinese authorities.

BREAKING: Western University rescinds COVID-19 vaccine booster mandate

The school announced it was amending its vaccine policy ‘Based on the latest consultation with our medical experts and local public health.’

Administration officials at Western University have formally revoked the school's COVID-19 boosted mandate it arbitrarily placed on all staff, students and visitors to campus in late August 2022.

In an update issued to its community, Western’s vice-president of operations and finance says, “Based on the latest consultation with our medical experts and local public health, we are revoking our vaccination policy and will no longer require students, employees, and visitors to be vaccinated to come to campus.”

In the next breath, Western promotes vaccination as the “best defence” against severe COVID-19 illness and hospitalization. “Masks will still be required in instructional spaces in the winter term after the December break,” the statement continues.

Western has been ground zero in the battle for medical freedom and bodily autonomy in Canadian academia. Dr. Julie Ponesse was terminated from her position as an ethics professor after 20 years following her decision to resist the school's COVID-19 vaccine mandate when it was first introduced in the fall of 2021.

Ponesse explained her opposition to Western's vaccine mandate in a tearful video posted to her YouTube page, which went viral across the globe.

After her dismissal, Ponesse became the Ethics Scholar at Canada's largest civil liberties charity, The Democracy Fund (TDF). The organization filed appeal documents challenging the legitimacy of the vaccination policy on November 21, says TDF lawyer Mark Joseph. The court originally dismissed the application made by TDF against Western University on September 24.

Since joining TDF, Ponesse has published a best-selling book, My Choice: The Ethical Case Against COVID-19 Vaccine Mandates.

With the Public Order Emergency Commission’s fact-finding hearings now concluded, Commissioner Paul Rouleau has until February to deliberate and issue his report. While there is no precedent for the Emergencies Act’s use, the law spells out the threshold needed for its use to be justified.

Understanding this requires looking at the Emergencies Act as well as the Canadian Security Intelligence Service Act.

The Emergencies Act details four types of emergency – a public welfare emergency, a public order emergency, an international emergency, a war emergency. When Justin Trudeau’s government invoked the act on Feb. 14, it declared a public order emergency, which means Part II of the act is the pertinent section.

Under section 16, a “public order emergency means an emergency that arises from threats to the security of Canada and that is so serious as to be a national emergency.”

This is where the CSIS Act comes in. The Emergencies Act says the term “threats to the security of Canada” “has the meaning assigned by section 2 of the Canadian Security Intelligence Service Act.”

In full:

  • (a) espionage or sabotage that is against Canada or is detrimental to the interests of Canada or activities directed toward or in support of such espionage or sabotage,
  • (b) foreign influenced activities within or relating to Canada that are detrimental to the interests of Canada and are clandestine or deceptive or involve a threat to any person,
  • (c) activities within or relating to Canada directed toward or in support of the threat or use of acts of serious violence against persons or property for the purpose of achieving a political, religious or ideological objective within Canada or a foreign state, and
  • (d) activities directed toward undermining by covert unlawful acts, or directed toward or intended ultimately to lead to the destruction or overthrow by violence of, the constitutionally established system of government in Canada,

The CSIS Act is clear that its definition of security threats “does not include lawful advocacy, protest or dissent” unless that protest incorporates any of the four listed activities.

While the convoy did receive donations from the United States and elsewhere, the Commission heard that the meaning of “foreign influenced activities” refers specifically to influence by foreign states, not protest sympathizers who happen to live in other countries.

Even if there exists a “threat to the security of Canada” as defined by the Emergencies Act and CSIS Act, the former requires it rise to the level of a “national emergency,” which has its own definition.

From section 3 of the Emergencies Act:

For the purposes of this Act, a national emergency is an urgent and critical situation of a temporary nature that

  • (a) seriously endangers the lives, health or safety of Canadians and is of such proportions or nature as to exceed the capacity or authority of a province to deal with it, or
  • (b) seriously threatens the ability of the Government of Canada to preserve the sovereignty, security and territorial integrity of Canada and that cannot be effectively dealt with under any other law of Canada.

In the federal government’s closing arguments Friday, the government’s lawyer said that there were threats to public safety in Ottawa and other protest sites across the country. He also argued that the government considered all other alternatives under existing authorities and found them to be inadequate.

For there to be a public order emergency as defined by the Emergencies Act, there must be a threat to the security of Canada as defined by the CSIS Act, as well as a national emergency as defined by the Emergencies Act, and the situation must be outside the ability of existing laws in Canada to address.

There is a caveat in section 17(1) of the Emergencies Act, which is that the Governor in Council – the cabinet – ”believes, on reasonable grounds” that the threshold has been met.

This distinction was subject to a fair bit of scrutiny in the closing weeks of the Commission, especially with conflicting information coming from CSIS. CSIS found that there was no threat to the security of Canada as defined by the CSIS Act, but CSIS director David Vignault nonetheless recommended the invocation of the Emergencies Act.

National security and intelligence adviser Jody Thomas testified that the CSIS definition of security threats was “very narrow and outdated” and should be updated, though it is still the law of the land.

Rouleau’s report is due by statute February 20, 2023, the anniversary of the revocation of the public order emergency.
